Tom specialises in the following:

  • litigation and dispute resolution;
  • competition law and consumer protection;
  • regulatory investigations and enforcement.

Tom has acted for clients across a broad range of sectors including healthcare, pharmaceuticals, fast-moving consumer goods (FMCG), technology, manufacturing, energy and telecommunications.

Tom is an experienced litigator, having acted in numerous proceedings in the High Court, the Federal Court and the Supreme Courts of all mainland Australian States in addition to the Australian Competition Tribunal, the Administrative Appeals Tribunal and other State-based Tribunals. Tom has also acted in international arbitrations under both the UNCITRAL and ICC Rules.

Tom has particular experience acting in commercial contractual disputes, competition litigation actions conducted under Part IV of the Competition and Consumer Act (2010) (Cth) (CCA), including cartel conduct, misuse of market power and exclusive dealing, consumer law actions under the Australian Consumer Law (ACL), including misleading or deceptive and unconscionable conduct, shareholder disputes, advising on and acting in disputes under the Franchising Code of Conduct, acting in claims against directors and related issues under the Corporations Act (2001) (Cth), negligence claims and in administrative law matters.

Tom has represented and advised both the ACCC and private clients in relation to competition and consumer law issues, including merger clearances, responding to s 155 notices and enforcement actions under Part IV of the CCA and the ACL.

Tom also regularly advises clients on all contentious and potentially contentious issues arising from the entry into, performance and termination of commercial transactions. Tom is also experienced in advising on broader risk management issues and has assisted clients in implementing risk avoidance strategies.

Tom is a member of the Business Law Section of the Law Council of Australia and the Law Society of New South Wales.  Tom is currently the author of the Australian Chapter of The Private Competition Enforcement Review.

Prior to joining Webb Henderson in March 2013, Tom was a Senior Associate at Baker & McKenzie, Sydney.  In 2015, Tom was recognised as a “Rising Star” in Competition & Consumer Protection by Doyle’s Guide to the Australian Legal Profession.
